Tesla Sues Indian Battery Maker for Trademark Infringement

New Delhi, May 5, 2024 – Electric car manufacturer Tesla has filed a lawsuit against an Indian battery company, Tesla Power India Private Limited, for trademark infringement. Tesla claims the Indian company’s use of the brand name “Tesla Power” infringes on their registered trademark.

In a hearing at the Delhi High Court this week, Tesla sought damages and a permanent injunction to prevent the Indian company from using its brand name. Tesla argued that despite issuing a cease-and-desist notice in April 2022, Tesla Power India continues to advertise their lead-acid batteries using the “Tesla Power” brand.

Tesla Power India, however, contested the claims. They argued that their company predates Elon Musk’s Tesla and focuses solely on lead-acid batteries, with no intention of entering the electric vehicle market. They also highlighted that they have received all necessary government approvals under their current brand name.

The judge granted Tesla Power India three weeks to submit a written response after they presented documents supporting their defense. A representative from Tesla Power India stated to news agency Reuters that they have been operating in India for a significant period and have obtained all necessary clearances under their existing brand name.
